California Water Quality 3-Year Review - 45 Days to Comment

Water Quality Plan for North Coast region is Now Open for Public Comment

45-day public comment period (starting November 21, 2014) is now open to solicit public comment on the 2014 triennial review of the Water Quality Control Plan for the North Coast Region (Basin Plan) draft proposed Basin Plan amendment project priorities and editorial revisions to Chapters 1, 2, 4, and 5 of the Basin Plan. 

BACKGROUND

The North Coast Region encompasses watersheds from the Oregon state border to the Estero de San Antonio which drain to the Pacific Ocean, and includes Del Norte, Trinity, Humboldt, and Mendocino counties and portions of Siskiyou, Sonoma, Glenn, Modoc, Lake and Marin counties.  The Basin Plan describes beneficial uses for watersheds in the North Coast Region, and establishes objectives and programs to protect those beneficial uses.  The purpose of the triennial review is to examine the need to revise and update the Basin Plan, focusing the efforts of Planning staff for the next three-year period.  State and federal law require that the Basin Plan be reviewed periodically to accommodate changes in science, technologies, policies, and physical characteristics of the planning areas.

Based on stakeholder, internal comments, and a review of regulatory program needs, Regional Water Board staff has identified a number of potential Basin Plan amendment projects as high priorities under the 2014 triennial review of the Basin Plan.  These potential Basin Plan amendment projects are summarized in the staff report dated November 21, 2014; Triennial Review of the Water Quality Control Plan for the North Coast Region for 2014.  The proposed Basin Plan amendment project priorities and proposed editorial revisions to Chapters 1, 2, 4, and 5 of the Basin Plan are included as appendices to the staff report.  The staff report and associated documents can be viewed / downloaded from the Regional Water Board website located at:

DOCUMENT AVAILABILITY

The Regional Water Board held a public workshop in Santa Rosa on November 19, 2014 to solicit comments regarding staff’s draft proposed Basin Plan amendment project priorities. Written public comments on the staff report, proposed editorial amendments, and draft proposed Basin Plan amendment project priority list must be submitted by 5:00pm on January 9, 2015.  A public hearing is tentatively scheduled for March 12, 2014 and will be separately noticed.

California Water Quality 3-Year Review - 45 Days to Comment

Section 13240 of the Porter-Cologne Water Quality Control Act and Section 303 (c)(1) of the federal Clean Water Act require a review of basin plans at least once each three-year period to keep pace with changes in regulation, new technologies, policies, and physical changes within the region.

The Regional Water Board is responsible for reviewing the Basin Plan, and is required to: 1) identify those portions of the Basin Plan which are in need of modification or new additions; 2) adopt standards as appropriate; and 3) recognize those portions of the Basin Plan which are appropriate as written. The review includes public hearings to allow the public to identify issues for the Regional Water Board to consider for incorporation into its Basin Plan. After public input is received, the Regional Water Board evaluates if Basin Plan revisions are needed, and develops and adopts by resolution a priority list and schedule for consideration of needed Basin Plan revisions for the next three year period.

The Regional Water Board submits its Triennial Review to the State Water Resources Control Board (State Water Board) for and the U.S. Environmental Protection Agency for their review.

Staff is concluding the 2014 Triennial Review of the Water Quality Control Plan for the North Coast Region (Basin Plan). Interested parties were invited to submit their recommendations for issues or projects that should be considered during the 2014 Triennial Review. Recommendations were collected by staff up through close of business June 20, 2014. In addition, three public workshops were held in Santa Rosa (April 8, 2014), Redding (April 9, 2014) and Fortuna (May 8, 2014). Staff presented an overview of the Basin Plan, the Triennial Review process, and the status of the 2011 Triennial Review list of basin planning priorities. These workshops were an opportunity for the public to alert staff and the Regional Water Board of the water quality issues and concerns it believes require amendment of the Basin Plan and placement on the 2014 Triennial Review list of priorities. Oral comments on the 2014 Triennial Review of the Basin Plan were made during each of these public workshops and have been made a part of the administrative record, as were written recommendations received by June 20, 2014.

A public workshop was held on November 19, 2014 where staff presented its draft proposed ranking of potential Basin Plan Amendment projects.. A draft staff report describing each of the proposed Basin Plan amendment projects and their proposed ranking is now available for a 45-day public comment period.. Also included in the staff report are proposed editorial revisions to Chapters 1, 2, 4 and 5 of the Basin Plan. Written comments will be accepted up through close of business on January 9, 2015. A public hearing is tentatively scheduled for March 12, 2015.
